The U.S. Treasury Department published a proposed rule classifying the refundable portions of the Child Tax Credit, Earned Income Tax Credit, America Opportunity Tax Credit, and the Adoption Tax Credit as “federal public benefits,” which limits these to U.S. citizens and a narrow list of “qualified immigrants.” This would create hardship for 200,000-700,000 taxpayers from low- and moderate-income, immigrant and/or mixed-status families. In response, UnidosUS, Protecting Immigrant Families, and CTAN collaborated to a sign-on comment opposing the proposed rule. The comment was submitted in early October 2026 with nearly 200 organizations joining the sign-on effort.
